कोरोना की दूसरी लहर ने पूरे देश को अपनी चपेट में ले लिया है और प्रत्येक दिन नए मामलों की संख्या 4 लाख को पार कर गई है। विशेष रूप से महामारी की दूसरी लहर का जवाब देने के लिए दवाओं और टीकों समेत विभिन्न चिकित्सा उत्पादों को देश में सस्ती कीमत पर उपलब्ध कराने की तत्काल आवश्यकता है। यद्यपि रेमेडिसवीर और फ़ेविपवीर का स्थानीय उत्पादन हो रहा है, लेकिन समस्या की गंभीरता के कारण बढ़ती माँग को पूरा करने के लिए उपलब्ध मात्रा अत्यधिक अपर्याप्त है। एक घातक "साइटोकिन स्टॉर्म" के साथ कोरोना रोगियों के इलाज के लिए एक अन्य महत्वपूर्ण दवा टोसिलिज़ुमाब है, जिसका भारत में उत्पादन नहीं होता है। आवश्यकताओं को पूरा करने के लिए इस दवा का आयात अत्यधिक अपर्याप्त है।
हालांकि रेमेडिसवीर के लिए कंपनियों ने मूल्य में स्वैच्छिक कमी की है, यह अभी भी बहुत अधिक है और 899 रुपये और 3490 रुपये प्रति शीशी के बीच है। इस संबंध में रिपोर्ट बताती है कि उचित लाभ सहित रेमेडिसविर की पूर्ण लागत 9 अमरीकी डॉलर के आसपास है, यानी लगभग 666 रुपये। दूसरी ओर, टोसीलिज़ुमाब की क़ीमत 40000 रुपये प्रति शीशी है। वर्तमान परिदृश्य के मद्देनज़र आम जनता कॉर्पोरेट लालच के दबाव में पिस रही है, जिस पर किसी भी हालत में पर अंकुश लगाने की आवश्यकता है।
इस संदर्भ में, स्वदेशी जागरण मंच वैश्विक कॉरपोरेट बिल गेट्स के उस कथन का पुरजोर विरोध करता है, कि वे वैक्सीन फार्मूला, भारत और अन्य देशों के साथ साझा करने के ख़िलाफ़ हैं । यह इस सदी की वीभत्स महामारी के समय में भी कॉर्पोरेट लालच की एक और अभिव्यक्ति है। इन दवाओं की कीमतों की सीलिंग जैसे उपायों को लागू करने की तत्काल आवश्यकता है। राज्य सरकार की खरीद और निजी अस्पतालों के लिए दोनों कंपनियों द्वारा घोषित वैक्सीन की कीमतें बहुत ज़्यादा हैं और इससे देश में टीकाकरण की गति धीमी हो सकती है। खासकर एक महामारी के दौरान दवाओं और टीकों में अनैतिक मुनाफ़ा सभी परिस्थितियों में अनुचित है,।
प्रतिस्पर्धा कीमतों को कम करने का सबसे अच्छा तरीका है। पेटेंट सुरक्षा इन दवाओं के सामान्य उत्पादन के लिए प्रमुख बाधा है। हालांकि 7 भारतीय कंपनियां स्वैच्छिक लाइसेंस के तहत रेमेडिसवीर बना रही हैं, लेकिन मांग को पूरा करने के लिए उसके उत्पादन की मात्रा पर्याप्त नहीं है, और कीमत सामर्थ्य के दृष्टिकोण से बहुत अधिक है। सरकार को पेटेंट अधिनियम में सार्वजनिक स्वास्थ्य सुरक्षा उपायों का उपयोग करना चाहिए और आने वाले दिनों में और अधिक कंपनियों को अनिवार्य लाइसेन्स के माध्यम से इन दवाओं के उत्पादन की अनुमति देनी चाहिए।
टीका के मामले में, देश को कम से कम 70% आबादी का टीकाकरण करने के लिए लगभग 195 करोड़ खुराक की आवश्यकता है। यह दोनों कंपनियों द्वारा अकेले पूरा नहीं किया जा सकता है। उत्पादन शुरू करने के लिए अधिक विनिर्माण लाने की तत्काल आवश्यकता है। प्रौद्योगिकी हस्तांतरण की सुविधा के लिए, सरकार को पेटेंट और व्यापार रहस्य सहित बौद्धिक संपदा बाधाओं को दूर करने के लिए उपाय करने होंगे।
स्वदेशी जागरण मंच देशभक्त नागरिकों का आह्वान करता है कि वे इस कठिन समय में जरूरतमंदों की सेवा करने के साथ-साथ वैश्विक मुनाफाखोरों के खिलाफ आवाज भी उठाएं।
भारत सरकार को वैश्विक इन जन भावनाओं को वास्तविकता में बदलने के लिए, सभी चिकित्सा उत्पादों को वैश्विक कल्याण वस्तु घोषित करते हुए निम्नलिखित उपाय करने चाहिए।
इस पृष्ठभूमि के मद्देनजर स्वदेशी जागरण मंच भारत सरकार से दृढ़ता से आग्रह करता है कि:
• स्वदेशी जागरण मंच ने देशभक्त नागरिकों का आह्वान करता है कि वे इन कठिन समय में जरूरतमंदों की सेवा करने के साथ-साथ वैश्विक मुनाफाखोरों के खिलाफ आवाज उठाएं।
भारत सरकार को वैश्विक इन जन भावनाओं को वास्तविकता में बदलने के लिए, सभी चिकित्सा उत्पादों को वैश्विक जन वस्तु घोषित करते हुए निम्नलिखित उपाय करने चाहिए।
इस पृष्ठभूमि के मद्देनजर स्वदेशी जागरण मंच भारत सरकार से दृढ़ता से आग्रह करता है कि:
• रेमेडीसविर, फेविरेसीर, टोसीलुजुमाब जैसी दवाओं के उत्पादन और मोलनुपीरविर जैसी नई दवाओं के उत्पादन के लिए या तो सरकार धारा 100 के तहत अनिवार्य लाइसेंस के प्रावधानों का उपयोग करे या धारा 92 के तहत अनिवार्य लाइसेंस जारी करे।
• कोवैक्सीन और कोविलफील्ड के उत्पादन को बढ़ाने के लिए सभी संभावित निर्माताओं के लिए व्यापार रहस्य सहित टीकों के प्रौद्योगिकी हस्तांतरण की सुविधा सुनिश्चित की जाए।
• कुछ कंपनियों के बजाय तकनीकी क्षमताओं के साथ अधिक फार्मा कंपनियों के लिए व्यापक रूप से वैक्सीन उत्पादन लाइसेन्स दिए जाएँ।
• स्पुतनिक V वैक्सीन का स्थानीय उत्पादन शुरू करने के लिए नियामक मंजूरी प्रदान की जाए ।
• उत्पादन लागत आधारित फ़ार्मूले के आधार पर दवाओं और टीकों की कीमतों पर सीलिंग लगाई जाए।
• वैश्विक स्तर पर दवाओं और वैक्सीन के उत्पादन के लिए प्रौद्योगिकियों का स्थानांतरण सुनिश्चित हो।
• वैश्विक स्तर पर सभी प्रासंगिक अंतरराष्ट्रीय मंचों पर प्रौद्योगिकी हस्तांतरण की सुविधा की आवश्यकता और बौद्धिक सम्पदा अधिकारों की छूट की माँग को आगे बढ़ाया जाए। इस हेतु जी 7, जी 20 और अन्य समूहों में राजनयिक प्रयासों में तेजी लायी जाए ।

The second wave of COVID is sweptwing the country and the number of new cases on each day has crossed 4 lakhs. There is an urgent need for various medical products to effectively respond to the second wave of pandemic especially medicines and vaccines to be made available at affordable prices in the country. Though the local production of Remdesivir and Favirapvir is taking place, the available quantity is highly inadequate to meet the increasing demand due to the severity of the problem. Another important medicine to treat COVID 19 patients with a deadly "cytokine storm" is Tocilizumab, which is not produced in India. The importation of this medicine is highly inadequate to meet the requirements.
Though there is a voluntary price reduction for Remdesivir it is still very high and ranges between Rs 899 and Rs 3490 per vial. Reports in this regard state the cost of the full course of Remedsivir including reasonable profit is around USD 9 i.e. around Rs 666. On the other hand, the cost of Tocilizumab is Rs 40000 per vial. Under the present scenario the general public is reeling under the corporate greed, which needs to be curbed at any cost.
In this context, Swadeshi Jagran Manch strongly deplores the statement of global corporate leader, Bill Gates that vaccine formula shouldn’t be shared with India and other countries. This is nothing but yet another manifestation of corporate greed to profit from worst pandemic of the century. There is an urgent need to invoke measures like ceiling of the prices of these medicines. The prices of vaccine announced by both companies for the state government procurement and private hospitals are exorbitant and affect the acceleration of vaccination in the country. Unreasonable profit for medicines and vaccines are unjustifiable in all circumstances, especially in a pandemic.
Introduction of the competition is the best way to lowering the prices. Patent protection is the major barrier to the generic production of these medicines. Though 7 Indian companies are making Remdesivir under the voluntary license the quantity is not enough to meet the demand, and the price is very high from the point of view of affordability. Government should use the public health safeguards in the Patents Act and permit more companies to produce these medicines in the coming days .
In the case of vaccine, the country needs nearly 195 crores of doses to cover at least 70% of the population. This cannot be fulfilled by the two companies alone. There is an urgent need to bring more manufactures to start the production. To facilitate the technology transfer, Government has to take measures to overcome the intellectual property barriers including patent and trade secret.
The government of India should treat all medical products to respond to COVID 19 as a global public good and take the following measures to translate the idea of a global public good into a reality.
Swadeshi Jagran Manch calls upon the patriotic citizens to raise their voice against the global profiteers along with serving the needy in these difficult times.
Against this background Swadeshi Jagran Manch strongly urge the Government of India to:
• Issue either government use license under Section 100 or compulsory licence under section 92 to scale up production of medicines like Remdesivir, Faviracire, Tociluzumab and new medicines like Molnupiravir.
• Facilitate technology transfer of vaccines including the trade secrets to all potential manufacturers to scale up the production of Covaxin and Covishield.
• License vaccine production widely to more pharma companies with technological capabilities, instead of a few companies.
• Provide the regulatory clearance to start the local production of the Sputnik V vaccine.
• Impose ceiling of prices of COVID19 medicines and vaccines taking into account the cost of production based formula.
• Transfer the technologies for the production of medicines and vaccine globally.
• Articulate the need to waiver of IP and facilitation of technology transfer in all relevant international forums at the global level and accelerate diplomatic efforts at G7, G20 and other groupings.

2.Proposed Press Release SJM Demands the Revision of the Governments Affidavit in the Supreme Court (Not Released)
The Swadeshi Jagran Manch (SJM) express its utmost concern on the Government’s assertions on the issuance of compulsory license on medicines required for the treatment of COVID19 patients. The latest affidavit filed in the Supreme Court states:
“ Any exercise of statutory powers either under the patents act 1970 read with Trips agreement and Doha declaration or in any other way can only prove to be counter-productive at this stage, the central government is very actively engaging itself with global organisations at a diplomatic level to find out a solution in the best possible interest of India. It is earnestly urged that any discussion or a mention of exercise of statutory powers either for essential drugs or vaccines having patent issues would have serious, severe and unintended adverse consequences in the countries efforts being made on global platform using all its resources, good-will and good-offices though diplomatic and other channels."
This is a completely misplaced concern. Further such assertion ignores the legislative intent behind the public health safeguards in the Patents Act 1970 like the compulsory license or government use. These provisions are incorporated in the Patents Act to check the abuse of patents and to ensure access to patented medicines at an affordable price. It is also quite amusing that India a vocal advocate of the use of TRIPS flexibilities is changing its stance, while the USA, the biggest opponent of TRIPS flexibilities asking countries to make use of the TRIPS flexibilities to scale up production of COVID 19 medical products.
Swadeshi Jagran Manch firmly believes that the need of the hour is to scale-up up the production of both medicine and vaccines to ensure availability and accessibility. The best way to do this is to promote competition in the market for these products. Currently, patents are preventing both availability and affordability of medicines used for COVID19 like Remdesivir and Tocilizumab. The current situation is demanding the invocation of those safeguards. Many countries including Israel, Hungary, Russia etc. have already issued compulsory license to facilitate the generic production of COVID19 medicines.
It is an irony that people in India, which take pride as the pharmacy of the developing world, is facing an acute shortage of medicines and vaccines during this pandemic. This shortage is not the result of a lack of technological capacity or the lack of tools but the result of certain vested interest among the bureaucrats and advisors who favours the rent-seeking behaviour of the pharmaceutical companies.
SJM also strongly urge the government to scale up the vaccine production through open licensing and also press the untapped manufacturing facilities existing in the public and private sector. HLL facility in the Chengalpattu District of Tamil Nadu is an example of an unutilised facility existing in the private sector.
We call upon the highest political leaders in the government to urgently intervene and reverse the stand taken in the affidavit, which places pharma profit above the peoples’ life. Further, the political leadership should take note of the contradictory stand of the government seeking diplomatic support on the TRIPS Waiver and refusing to use the compulsory licensing to facilitate generic production. This is the time Government should do the walk the talk and set an example to the whole world. Therefore, SJM demands the issuance of a government use license on all the patented medicine and vaccine technologies by invoking Section 100 of the Indian Patent Act 1970. We also call for the lifting of the trade secret protection on COVID19 vaccines and press for relevant technology transfer. (Proposed but not released)

Digital Signature Campaign for Universal Access of Vaccine and Medicines
As we are aware that humanity is facing a worst medical crisis these days due to second wave of the Covid19. To deal with the situation, country needs sufficient supply of vaccine, medicines and different types of medical equipments. Swadeshi Jagran Manch firmly believes that many Indian manufacturers have the capacity and expertise in the production of essential medicines and vaccine, provided intellectual property rights hurdles are removed with technology transfer and trade secret issues resolved. Patent protection is the major barrier to the generic production of these medicines. Many Indian companies are already making Remdesivir under the voluntary license, however, the quantity is not sufficient to meet the demand, and the price is also very high from the point of view of affordability. We understand that the government needs to use the public health safeguards in the Patents Act and permit more companies to produce these medicines in the coming days.
As we may be requiring nearly 2 billion doses of vaccine in the next 6 months, we need to involve many more companies in manufacturing of these vaccines. It’s heartening to note that licences have already been issued to many companies for Covaxin and also for remdesivir. We may have to multiply these efforts.
We reiterate our demand for declaring all medical products required to respond to COVID 19 as global public good, and put an end to profiteering to serve the needy in these difficult times.
In order to make it possible to ensure availability of vaccine and essential medicines for Covid 19, Swadeshi Jagran Manch has started a digital signature campaign a requesting the patriotic citizens to sign the petition with the following appeal:
(i) The WTO for granting waiver in the provisions of TRIPS.
(ii) The global pharma companies for voluntarily giving patent free rights including technology transfer, passcodes and raw material to other pharma manufacturers for the sake of humanity.
(iii) The government for taking necessary steps including using its sovereign rights to grant the compulsory license to other pharma manufacturers to produce vaccine and medicines.
(iv) Other concerned individuals and organizations to come forward and facilitate Universal Access to Vaccines and Medicines to fight against Corona.

वैक्सीन और दवाओं की वैश्विक सर्वसुलभता के लिए डिजिटल हस्ताक्षर अभियान
जैसा कि हम जानते हैं कि कोविड-19 की दूसरी लहर के कारण मानवता इन दिनों अभूतपूर्व चिकित्सा संकट का सामना कर रही है। स्थिति से निपटने के लिए देश को वैक्सीन, दवाओं और विभिन्न प्रकार के चिकित्सा उपकरणों की पर्याप्त आपूर्ति की आवश्यकता है। स्वदेशी जागरण मंच का दृढ़ विश्वास है कि कई भारतीय निर्माताओं के पास आवश्यक दवाओं और वैक्सीन के उत्पादन की क्षमता और विशेषज्ञता है, बशर्ते कि प्रौद्योगिकी हस्तांतरण और व्यापार रहस्य के मुद्दों को हल करने के साथ बौद्धिक संपदा अधिकार की बाधाएं दूर हों। पेटेंट संरक्षण इन दवाओं के जेनेरिक उत्पादन में प्रमुख बाधा है। कई भारतीय कंपनियां पहले से ही रेमडेसिविर को स्वैच्छिक लाइसेंस के तहत बना रही हैं, हालांकि, मात्रा मांग को पूरा करने के लिए पर्याप्त नहीं है, और कीमत भी सामर्थ्य की दृष्टि से बहुत अधिक है। हम समझते हैं कि सरकार को पेटेंट अधिनियम में निहित जनस्वास्थ्य सुरक्षा उपायों का उपयोग करने और आने वाले दिनों में अधिक कंपनियों को इन दवाओं के उत्पादन की अनुमति देने की आवश्यकता है।

हम कोविड 19 के लिए आवश्यक सभी चिकित्सा उत्पादों को जनता के लिए आवश्यक वस्तु (पब्लिक गुड) घोषित करने की अपनी मांग को दोहराते हैं, और इस कठिन समय में जरूरतमंदों की सेवा करने के लिए मुनाफाखोरी को समाप्त करने की माँग करते हैं।
कोविड-19 के लिए टीके और आवश्यक दवाओं की उपलब्धता सुनिश्चित करने के लिए स्वदेशी जागरण मंच ने एक डिजिटल हस्ताक्षर अभियान शुरू किया है, जिसमें देशभक्त नागरिकों से निम्नलिखित अपील के साथ याचिका पर हस्ताक्षर करने का अनुरोध किया गया है:
1. विश्व व्यापार संगठन, बौद्धिक संपदा अधिकार के प्रावधानों में छूट दे।
2. वैश्विक दवा निर्माता और वैक्सीन निर्माता कपनियां स्वेच्छा से, मानवता के लिए, अन्य निर्माताओं को प्रौद्योगिकी हस्तांतरण सहित पेटेंट मुक्त अधिकार दें।
3. सरकार अन्य दवा निर्माताओं (वैक्सीन व दवाईयां) को अनिवार्य लाइसेंस देने के लिए अपने संप्रभु अधिकारों का उपयोग करने सहित आवश्यक कदम उठाये।
4. कोरोना के खिलाफ लड़ने के लिए एवं वैक्सीन और दवाओं की वैश्विक उपलब्धता सुनिश्चित करने के लिए, सभी संबंधित व्यक्ति और संगठन बढ़-चढ़कर आगे आएँ ।

SUB: TRIPS Waiver Proposal
Dear Ambassdor Astuto,
The Swadeshi Jagran Manch (SJM) is writing to draw your attention to the European Union’s (EU’s) reluctance to support a text-based negotiation of TRIPS Waiver proposal to suspend certain intellectual property (IP) for the COVID19 medical products.
As you are aware that in view of the COVID-19, a worst pandemic faced by the humanity, India along with South Africa has proposed in October 2020 in WTO and urged WTO to grant a waiver for limited years (which will be negotiated by the TRIPS Council) from the implementation, application and enforcement of specific provisions of the TRIPS agreement for the prevention, containment and treatment of COVID-19.
After the announcement of the USTR on 5th May to support the text-based negotiations on the waiver proposal many countries came forward to support the negotiation. However, the announcement of the EU is not clear in its support to the text-based negotiation. Further, the EU attempted to limit it to the scope of the TRIPS Waiver to only to the vaccine patents. As you know the international human rights obligation also includes an obligation to desist from taking measures that result in the infringement of human rights in other countries. These attempts to support the monopoly in COVID 19 medical products goes against the concept of solidarity and even violate the right to health guaranteed under Article 12 of the International Covenant on Economic Social and Cultural Rights (ICESCR).
We would like to state that the best option before the whole world is to scale up the production of various COVID19 medical products by removing the legal barrier against the freedom of operation. The approach of charity i.e. donating vaccines and other medical products is not a sustainable strategy. Further such an approach has also failed so far to effectively addressing the problem. This kind of approach is likely to lead to continuation of monopoly by a few companies over Covid19 medical products; and it will only accentuate the miseries of the people, as the same is likely to cause shortages and unaffordable treatment, which India and world has gone through in recent months.
Against this background, we request the European Union to unconditionally support the TRIPS Waiver Proposal and constructively engage in the text-based negotiation to conclude the negotiation at the earliest without compromising the purposes and objectives behind the proposal.

स्वदेशी जागरण मंच यह पत्र कोविड-19 चिकित्सा उत्पादों के लिए कुछ बौद्धिक संपदा (IP) को निलंबित करने के ट्रिप्स (TRIPS) छूट प्रस्ताव की दस्तावेज-आधारित बातचीत का समर्थन करने के लिए यूरोपीय संघ की अनिच्छा की ओर आपका ध्यान आकर्षित करने के लिए लिख रहा है।
जैसा कि आप जानते हैं कि कोविड-19, मानवता के सामने सबसे भयानक महामारी के मद्देनजर, भारत ने दक्षिण अफ्रीका के साथ मिलकर अक्टूबर 2020 में डब्ल्यूटीओ में प्रस्ताव रखा है और डब्ल्यूटीओ की ट्रिप्स काउंसिल, से सीमित वर्षों (जिस पर बातचीत की जाएगी) के लिए कोविड-19 की रोकथाम और उपचार के लिए ट्रिप्स समझौते के विशिष्ट प्रावधानों के कार्यान्वयन, आवेदन और प्रवर्तन से छूट देने का आग्रह किया है।
जैसा कि आप जानते हैं कि अंतरराष्ट्रीय मानवाधिकार दायित्व में ऐसे उपाय करने से बचने का दायित्व भी शामिल है जिसके परिणामस्वरूप अन्य देशों में मानवाधिकारों का उल्लंघन होता है। दस्तावेज़ आधारित वार्ता को अवरुद्ध करने का प्रयास कोविड-19 चिकित्सा उत्पादों के एकाधिकार के लिए एक अप्रत्यक्ष समर्थन है जो एकजुटता की अवधारणा के खिलाफ जाता है। और यहां तक कि यह आर्थिक सामाजिक और सांस्कृतिक अधिकारों पर अंतर्राष्ट्रीय वाचा (ICESCR) के अनुच्छेद 12 के तहत गारंटीकृत स्वास्थ्य के अधिकार का भी उल्लंघन करता है।
हम यह बताना चाहेंगे कि हमारे सामने सबसे अच्छा विकल्प,ऑपरेशन की स्वतंत्रता के खिलाफ कानूनी बाधा को हटाकर, विभिन्न कोविड19 चिकित्सा उत्पादों के उत्पादन को बढ़ाना है। ‘दान’ का दृष्टिकोण यानी टीके और अन्य चिकित्सा उत्पादों का ‘दान’ करना एक स्थायी रणनीति नहीं हो सकती है। इसके अलावा इस तरह का दृष्टिकोण भी अब तक समस्या को प्रभावी ढंग से हल करने में विफल रहा है। इस तरह के दृष्टिकोण से कुछ कंपनियों द्वारा कोविड-19 चिकित्सा उत्पादों पर एकाधिकार जारी रखने की संभावना है; और यह केवल लोगों के दुखों को बढ़ाएगा, जिसे भारत और दुनिया ने हाल के महीनों में झेला है, क्योंकि इससे चिकित्सा उत्पादों की कमी बनी रहेगी और उपचार वहनीय नहीं हो सकेगा।
यह भी ध्यान रखना महत्वपूर्ण है कि पेटेंट ही एकमात्र बाधा नहीं है; टीकों, दवाओं आदि के उत्पादन को बढ़ाने के लिए व्यापार रहस्य तक पहुंच भी महत्वपूर्ण है। इसलिए, यूरोपीय संघ ने प्रस्तावित कोविड-19 वैक्सीन के वास्तविक मुद्दे को संबोधित करने के बजाय, पेटेंट पूल के विषय को लाकर मुद्दे को भटकाने की रणनीति अपनायी है। इस अभूतपूर्व अंतर्राष्ट्रीय स्वास्थ्य संकट पर लोगों के स्वास्थ्य को लाभ से ऊपर रखना महत्वपूर्ण है।
